  1. Purpose and scope

These terms govern access to, contracting for and use of ReHub (the “Platform”) and the related services offered by DyCare (together, the “Service”). They apply to healthcare organisations, referring entities, healthcare professionals, independent professionals, patients and, where applicable, legal representatives or guardians (“Users”).

If DyCare has entered into a specific contract with an organisation, professional or referring entity, that contract prevails in the event of conflict. Anyone accepting these terms for an organisation confirms that they have authority to bind it.

  1. Description and nature of ReHub

ReHub is a digital rehabilitation solution that, depending on the contracted configuration, enables therapeutic programmes to be prescribed and performed, exercises and content to be accessed, results to be recorded, remote follow-up to be carried out and patients and professionals to communicate.

ReHub is a medical device and must be used in accordance with its intended purpose, labelling, instructions for use, contraindications and other applicable regulatory documentation. These terms do not replace that documentation. In matters of safe clinical use, the current instructions for use and regulatory documentation prevail.

ReHub does not replace clinical judgement, diagnosis, therapeutic indication, face-to-face care when needed or emergency services.

  1. Access and contracting models

Access may be provided under a contract between DyCare and a healthcare organisation, company, insurer, public authority or other referring entity; a direct contract with an independent professional; or an online subscription where available.

Scope, term, users, functionality, support, price and other commercial conditions are those shown during purchase or specified in the relevant contract. DyCare supplies healthcare professionals only where expressly agreed for a particular contract or project.

  1. Registration, account and credentials

Users must provide accurate, complete and up-to-date information. Accounts are personal and may not be shared. Users must protect their credentials, use available authentication measures and immediately report unauthorised access or account incidents to support@dycare.com. DyCare may temporarily block an account where necessary to protect the User, third parties, the Platform or processed information.

  1. Minors and Users requiring assistance

A minor’s use of ReHub depends on the clinical indication, the configuration and policy of the relevant organisation, applicable law and, where required, the consent or authorisation of the parent, guardian or legal representative.

The organisation and professional must verify that access is appropriate and that all required authorisations have been obtained. Supervision must reflect the minor’s age, maturity, clinical situation and treatment. Equivalent safeguards apply to Users requiring assistance.

  1. Obligations of professionals and organisations

Within their responsibilities, professionals and organisations must verify identity, qualifications, registration and insurance; assess whether remote care is clinically appropriate; prescribe, adapt and supervise treatment according to professional standards; inform patients and obtain any required informed consent; act on alerts and clinical changes; use ReHub according to its intended purpose and instructions; and comply with applicable healthcare, professional, contractual and data-protection law.

Where DyCare supplies healthcare professionals under a specific contract, the parties’ responsibilities are governed by that contract and applicable law.

  1. Patient obligations and safety

Patients must provide relevant and accurate information, follow professional instructions, observe contraindications and safety measures, use suitable space and equipment and stop exercising if symptoms, pain or other circumstances require professional advice. ReHub is not an emergency channel; in an emergency the User must immediately contact the appropriate emergency or healthcare service.

  1. Camera, motion measurement and communications

Some features may require camera access to analyse movement in real time. Camera images are not stored or sent to DyCare servers as part of this feature; the necessary information is processed locally and only the results or derived parameters specified by the Service are recorded.

Chat and video-call features, when enabled, may be used only for authorised care or support purposes. Users may not record, distribute or reuse another person’s communications or images without a sufficient legal basis and authorisation.

  1. Prices, invoicing and payment

Where access is provided by an organisation or referring entity, patients do not pay DyCare unless expressly informed otherwise before contracting. Organisations pay the amounts in their contracts. Independent professionals purchasing online subscriptions pay the price, taxes and billing frequency shown before confirming the order. Payments may be processed through Stripe or another notified payment provider.

Recurring subscriptions renew for equivalent periods until cancelled unless otherwise stated. Before purchase, Users are informed of the total price, frequency, features, duration, renewal and cancellation process. Invoices are provided through the indicated channel or on request to support@dycare.com. DyCare may change prices for future renewals with at least one month’s notice. Non-payment may result in suspension after any legally or contractually required notice.

  1. Term, renewal and cancellation

The term is that agreed in the contract or subscription process. Unless otherwise stated, cancellation prevents the next renewal but does not refund a period already begun, except where required by law or a withdrawal right applies. Termination of an enabling contract may end linked patients’ access; the care provider must safeguard clinical continuity and legally required information.

  1. Consumer right of withdrawal

A User who legally qualifies as a consumer and enters into a distance contract with DyCare may withdraw within fourteen calendar days of contracting, without giving a reason, by sending an unequivocal statement to support@dycare.com.

If performance is requested during that period, the legally required consent must be given and the consumer may have to pay the proportionate price for services supplied before withdrawal. The right concerning digital content or services is lost only where every statutory condition and confirmation requirement is met. This clause does not make a business or professional purchaser a consumer.

  1. Permitted use and prohibited conduct

Users must act lawfully and diligently. They may not share accounts, impersonate others, access unauthorised data or features, introduce malicious code, bypass security, test vulnerabilities without authorisation, interfere with the Service, reverse engineer except where mandatory law permits it, upload unlawful or unauthorised content, use Platform data for unauthorised advertising, or use ReHub outside its intended purpose or contrary to warnings, contraindications or clinical instructions.

  1. User and professional content

Anyone uploading exercises, documents, images, videos or other material confirms that they hold the necessary rights and permissions. They retain their rights and grant DyCare a non-exclusive, limited licence for as long as needed to host, process, technically reproduce and make that material available to authorised Users. DyCare may remove or block unlawful, unsafe or non-compliant content. End-of-service handling follows the contract, privacy policy and legal retention, return or deletion duties.

  1. Intellectual and industrial property

ReHub, its software, design, databases, trade marks, documentation and proprietary content belong to DyCare or its licensors and are legally protected. Contracting grants only a limited, non-exclusive, non-transferable and revocable right of use during the Service term. No ownership rights are transferred. The names “DyCare” and “ReHub” must retain their correct spelling.

  1. Availability, maintenance and technical changes

DyCare applies reasonable measures to maintain availability, security and operation. It may perform maintenance, updates, corrections and changes needed for technical, regulatory, clinical or security reasons, giving advance notice of materially disruptive planned maintenance where reasonably possible. Availability may be affected by networks, devices, third-party services, force majeure or events outside DyCare’s reasonable control. Users must maintain supported devices, browsers and systems.

  1. Warranties and liability

DyCare is responsible for the conformity, safety and operation of ReHub within its intended purpose as required by applicable law and contract. It does not guarantee a specific clinical outcome, which depends on the patient, professional indication and supervision, and adherence.

Each party is liable for direct loss caused by wilful misconduct, fault, negligence or breach. Nothing excludes liability that cannot lawfully be limited, including liability for personal injury, defective products, consumer rights or data-protection duties. DyCare is not responsible for exclusively clinical decisions of independent professionals or organisations, or misuse contrary to the intended purpose, instructions or requirements, without prejudice to its mandatory liability as manufacturer, provider or contracting party.

  1. Data protection

Personal data are processed under the Privacy Policy, specific notices given to patients or professionals and, where relevant, the data-processing agreement with the organisation. Depending on context, the organisation, professional or referring entity may control care data and DyCare may act as processor. DyCare controls processing for which it determines purposes and means. Account deactivation does not necessarily mean immediate deletion where healthcare, contractual or legal retention duties apply.

  1. Suspension and termination

DyCare may suspend or terminate access for non-payment, security risk, unlawful use, serious breach, expiry of the enabling contract or regulatory need. Except in urgent, legally required or high-risk cases, prior notice and a reasonable opportunity to remedy will be provided where possible. Accrued rights and surviving duties remain unaffected; data and content are handled under the contract and applicable law.

  1. Changes to these terms

DyCare may change these terms for legal, regulatory, technical, security or Service reasons. Material changes are clearly notified before taking effect. Where consent is legally or contractually required, express acceptance will be requested. A User who rejects a material change may terminate before it takes effect, subject to amounts due for services already provided. Silence does not amount to consent where express consent is required.

  1. Notices and support

Service notices are sent to the User’s supplied contact details or displayed on the Platform. Users must keep those details current. Support, cancellation, withdrawal and terms-related communications must be sent to support@dycare.com.

  1. Governing law and jurisdiction

These terms are governed by Spanish law. In business-to-business or professional relationships, the courts of Barcelona have jurisdiction unless mandatory law or a different contract provides otherwise. For consumers, jurisdiction is determined by mandatory applicable law and this clause does not restrict their rights.

  1. Severability and mandatory law

If a provision is void or unenforceable, the remaining provisions remain effective. These terms are interpreted in accordance with mandatory law and do not restrict non-waivable rights of consumers, patients or data subjects.
